1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Jadia P.S. Case no.322 of 2022 registered under sections 307, 147, 148, 149, 323, 324, 341, 504, 506 and 34 of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, it is stated by the informant that being annoyed over the informant having married the girl from the family of the accused, the six named accused persons along with 15-20 accused persons entered the house of the informant. It is stated that on the orders of Anupam Mehta, Sarvesh Kumar resorted to fire from his gun as a result of which the informant sustained gunshot injury in his chest.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The cause of false implication of the petitioner is evident from the F.I.R. itself. No overt act has been alleged against this petitioner. The petitioner is in custody since 12.12.2022 and chargesheet has been submitted in the case.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the F.I.R. against the petitioner wherein no overt act has been alleged against him, the petitioner being in custody since 12.12.2022, chargesheet having been submitted in the case and the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Jadia P.S. Case no.322 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul.
