JUSTICE ARUN KUMAR ORAL ORDER 07-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with S.Tr. No. 343 of 2017 arising out of Katra P.S.Case No. 159 of 2013 registered under Sections 304B/34 of the Indian penal Code.

Allegation in brief against the petitioner, who happens to be husband of the deceased, is that when further demand of dowry was not fulfilled, he killed his wife.

Learned counsel for the petitioner submits that there is no eye witness of this case and in fact his wife died due to stomach pain.

Learned counsel for the State submits that petitioner is husband and due to non-fulfillment of demand of dowry murdered her and postmortem report revealed that she was killed by

Patna High Court Cr.Misc. No.59585 of 2017 (7) dt.07-03-2018 2/2 strangulation.

Having considered the aforesaid facts and circumstances, the prayer of bail of the petitioner is rejected. (Arun Kumar, J) Sujit/- U T
