JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 323, 498, 504/34 of the Indian Penal Code and Sections 3 / 4 of the Dowry Prohibition Act. The allegation against the petitioner is of torturing the complainant for non-fulfilment of additional demand of dowry. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent and he has been falsely implicated in the present case. It is also submitted that the petitioner is ready to deposit an amount of Rs.800/- per month in the court below, which may be released in favour of the complainant.
On behalf of the State it is submitted that petitioner is named in the F.I.R. and he is the husband of opposite party no. 2. Considering the aforesaid facts, the petitioner is directed to deposit an amount of Rs.800/- per month in the court below, which shall be released in favour of the complainant. Let the above named petitioner, in the event of arrest
Patna High Court Cr.Misc. No.26199 of 2015 (3) dt.22-09-2015 2 / 2 or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif , in connection with Bind P. S. Case no. 99 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
