The petitioner is apprehending his arrest in a case instituted under Sections 406, 420 and 34 of the Indian Penal Code.

Prosecution case is that a Committe consisting of 20 members was formed and it was agreed upon among the members that each member will deposit Rs. 1lac and can withdraw money as per his requirement. Petitioner was the Chairman of the Committee and after depositing some instalments he refused to deposit the balance of money. When he was asked to deposit money, informant and others were threatened to make them disappear.

It has been submitted on behalf of the petitioner that he has no criminal antecedent and he has been made accused due to village politics. In fact, petitioner had given loan of Rs. 1,30,000/- to one Sheo Lal Das which was grabbed by the informant for

On behalf of the State and on behalf of the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts, let the above named petitioner, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Benipur, Darbhanga, in connection with Bahera P.S. Case no. 160 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
