The petitioner is in custody since 13.10.2017 in connection with Motihari Town P.S. Case No. 726 of 2017 for the offence registered under Sections 401 and 413 of the Indian Penal Code.
Leaned counsel for the petitioner submits that only on suspicion that the petitioner was taking part in the conspiracy and planning a dacoity in the house of one Rinku Alam, the petitioner was taken into custody. It is further submitted that there is no recovery of any incriminating article from the possession of the petitioner.
Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.42560 of 2018 (2) dt.19-07-2018 the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Motihari Town P.S. Case No. 726 of 2017.
