Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 5.5.2017 passed in Cr. Misc. No.13928 of 2017, with direction to the learned trial court to expedite the trial and try to conclude it as soon as possible. Submission of the learned counsel for the petitioner is that the petitioner is in custody for about eleven months and there is no repetition of blow in this case.

Heard learned A.P.P. also.

From perusal of the report of the learned trial court it appears that in this case charge has been framed and the summons have been issued to the witnesses but not a single witness has been examined. The learned trial court has prayed for one year's time

Patna High Court Cr.Misc. No.57583 of 2017 (4) dt.20-12-2017 2/2 for conclusion of the trial.

Having heard both sides and in view of the facts and circumstances of the case, I am not inclined to grant bail to the petitioner at this stage, however as the charge has been framed, the learned trial court is directed to expedite the trial and try to conclude it within a period of seven months With the aforesaid observation, this application is dismissed.
