JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. At the very outset, learned counsel for the petitioner seeks permission to correct para-1 of the petition. Petitioner is permitted to make necessary correction in para-1 of the petition within course of the day. It is pointed out that petitioner was granted privilege of anticipatory bail by a Bench of this court vide order dated 09.10.2014 passed in Cr. Misc. No. 24179 of 2014 and was directed to surrender before the court below in connection with Kesaria P.S. Case No. 169 of 2012 within four weeks from 09.10.2014 but unfortunately, petitioner fell ill and he was under treatment from 01.10.2014 to 16.02.2016 which is evident from
Patna High Court Cr.Misc. No.22863 of 2016 (2) dt.13-06-2016 2/2 perusal of Annexure-B to the petition. It is further submitted that after getting the fitness certificate from the concerned doctor, petitioner has filed this modification petition. In view of the aforesaid submissions as well as facts and circumstances of the case, the order dated 09.10.2014 passed in Cr. Misc. No. 24179 of 2014 stands modified to this extent that petitioner must surrender before the court of Chief Judicial Magistrate, Motihari, East Champaran/concerned court in Kesaria P.S. Case No. 169 of 2012 within four weeks from today and if petitioner does so, the concerned court shall proceed in the light of order dated 09.10.2014 passed in Cr. Misc. No. 24179 of 2014. In the aforesaid manner, this petition filed under Section 482 of the Cr.P.C. stands disposed of. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
