JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-10-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Khagaria (Chtragupta Nagar) PS case no. 514 of 2017 registered for the offences punishable under Section 392 of Indian Penal Code.
The case of the prosecution is that four unknown accused persons had looted a sum of Rs. 3,29,300/- along with a mobile from the collection point of ITZ Cash Collection Point, Chitragupta Nagar and had then fled away. Subsequently, four suspects including the petitioner were apprehended.

The learned counsel for the petitioner submits that barring one case which also arises out of the present occurrence, the petitioner has a clean antecedent and he has been falsely implicated though no incriminating article has been recovered from his conscious possession nor he has been named in the FIR. For the reasons stated hereinabove, the petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria (Chitragupta Nagar) PS case no. 514 of 2017.
