The petitioners apprehend their arrest in Gopalganj Town P.S. Case No. 75 of 2018 registered for the offence under Sections 341, 323, 354, 504, 34 of the Indian Penal Code. The prosecution case is that on 24-01-2018, the complainant (informant) with her nanad were surrounded, abused and assaulted by petitioners & one co-accused and put pressure to withdraw the case iled by her i.e. Kateya P.S. Case No. 364 of 2017. It is further alleged that the accused also tried to outrage the modesty of complainant on gun point. It is submitted on behalf of petitioners that petitioners
Patna High Court CR. MISC. No.15135 of 2020(2) dt.08-07-2020 2/2 are innocent and have falsely been implicated in this case due to previous enmity. There is land dispute between the parties. It is further submitted that alleged occurrence has taken place on 24-01-2018, but the complaint was filed belatedly on 01-02-2018. Petitioners are full brothers.
Considering the aforesaid facts and circumstances, the bail application is allowed.
In the event of arrest or surrender within a period of six weeks from today, let the above-named petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Gopalganj in connection with Gopalganj Town P.S. Case No. 75 of 2018, subject to condition as laid down under Section 438(2) of the Cr.P.C.
