JUSTICE SUDHIR SINGH ORAL ORDER 17-07-2015 The petitioner is apprehending his arrest in connection with Complaint Case No. 1393C of 2014 for the offences instituted under Section 498(A) of the IPC.

Heard learned counsels for the petitioner, complainant and learned counsel for the State.

The prosecution story, in brief, is that the complainant was married with this petitioner in the year 2009 and at the time of Ruksadi her husband and other accused persons demanded Rs. 50,000/- but any how her Ruksadi was performed and she went to her matrimonial house, where after one and half years, she has been blessed with a daughter thereafter, her husband and other accused persons started committing cruelty and assault against her due to non-fulfilment of additional demand of dowry. She was

Patna High Court Cr.Misc. No.26230 of 2015 (2) dt.17-07-2015 2/2 assaulted and tortured by husband and other in-laws by various ways on various occasions. However, the parents of the complainant gave Rs. 10,000/- to the accused persons and ultimately she was ousted from her matrimonial house on 04.11.2014 after threatening to bring the reaming additional dowry of Rs. 40,000/- from her parents. The negotiation has not been settled.

A joint prayer has been made on their behalf that they are ready to stay together.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 1393(C) of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Nalanda at Biharshariff, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
