This application for anticipatory bail arises out of Ujiarpur P.S. Case No. 171 of 2018 for the offence under Sections 307, 323, 324, 325/34, 341, 379, 447, 504 and 506 of the Indian Penal Code.
There are six persons named in the First Information Report, who are said to have abused the informant and on objection having been raised, assaulted him and his son. It is alleged against petitioner No.3 that he assaulted the
Patna High Court CR. MISC. No.16345 of 2019(2) dt.15-03-2019 2/3 informant's son in his head with an iron rod. The accused persons are also said to have snatched some ornaments. Learned counsel appearing on behalf of the petitioners has submitted that petitioners No. 1 to 4 are full brothers and are sons of petitioner No.5. Petitioner No.6 also belongs to the same family and it is because of the civil dispute that some occurrence has taken place, in respect of which a counter case has also been lodged. The petitioners have no criminal antecedent as stated in the application. Considering the above submission, this application is allowed.
Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Dalsingsarai, district-Samastipur, in Ujiarpur P.S. Case No. 171 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their
