====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-04-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 117(2), 109, 329(3), 352, 351(2), 351(3) of the Bharatiya Nyaya Sanhita.

3. As per prosecution case, on the alleged date and

Patna High Court CR. MISC. No.16951 of 2025(2) dt.16-04-2025 2/3 time of occurrence, these petitioners came to the house of informant armed with lathi and arms and assaulted informant and his family members as a result of which two persons sustained injuries.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. Allegation of assault is general and omnibus and there is no allegation of specific overt act against these petitioners. Injuries sustained by the injured are simple in nature. Case and counter case.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P. S. Case No. 1007 of 2024, subject to condition as laid down under Section 482(2)
