JUSTICE ARUN KUMAR ORAL ORDER 26-07-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Sadar P.S.Case No.193 of 2018 (Special Case No. 53 of 2018) registered under Sections 341, 342, 372, 373, 366 A, 376 and 120 B of the Indian penal Code, Sections 3, 4, 5, 6 and 7 of the Immoral Trafficking Act, Section 23 of the Juvenile Justice Act and Sections 3 and 4 of the Protection of Children from the Sexual Offences Act.

Allegation in brief is that Police raided the house of one Akbar Khalifa and found a brothel being run there and several girls found indulged in fresh trade along with customers were apprehended by the police.

Patna High Court Cr.Misc. No.43386 of 2018(3) dt.26-07-2018 2/2 Submission is that the brothel was being run not in the house of the petitioners rather in the house of one Akbar Khalifa and the petitioner no. 2 is said to be the customer and the petitioners are in custody since 06.05.2018. Having considered the aforesaid facts and circumstances, the petitioners, namely, Md. Sajjad and Anish Kumar are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Ist Additional Sessions Judge- CumSpecial Judge (POCSO), Purnea in connection with Special Case No. 53 of 2018 arising out of Sadar P.S. Case No. 193 of 2018.
