JUSTICE ARUN KUMAR ORAL ORDER 14-12-2017 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody, seeks bail in Sheikhopur Sarai PS Case No. 111 of 2017 registered under Sections 147, 148, 149, 323, 325, 307 and 302 of the IPC.

The allegation in brief is that in the dead night the informant's son was called by one of the accused and thereafter they started assaulting his son. The informant with other family members went to the house of the accused and saw from the window his son being assaulted by all the family members causing his death, It is alleged that it was the land dispute due to which this occurrence was committed.

Learned Counsel for the petitioners submits that there is case and counter case and in fact the informant's son trespassed in the house of accused persons after mid night and made an attempt of rape on the daughter of petitioner No. 1 and when she raised alarm he made an attempt to jump and therefore sustained injury and died. The further submission is that all male and female members have been made accused in this case and the petitioners are ladies having

Patna High Court Cr.Misc. No.58039 of 2017 (2) dt.14-12-2017 no specific allegation and both the petitioners are in custody since 10.10.2017.

Learned Counsel for the informant submits that there are three injuries on the head and bruise on the back and the petitioners are also named and other family members have also been assaulted and injured.

Having considered the said facts and circumstances, especially the petitioners being ladies the petitioners, namely, Ranju Devi and Meera Devi are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM lst Sheikhpura in connection with Sheikhopur Sarai PS Case No. 111 of 2017.
