Petitioner seeks bail in a case registered for the offences punishable under Sections 387, 120(B) of the Indian Penal Code.
The FIR discloses the allegation of demand of ransom on mobile phone.
Submission of the learned counsel for the petitioner is that the said mobile is not of the petitioner and during the same period, the petitioner has been implicated in some other cases, mentioned in paragraph-3 of the petition. A perusal of the case diary would reveal that all the cases were against unknown
Patna High Court Cr.Misc. No.57253 of 2017 (3) dt.08-01-2018 and the referred mobile was not of the petitioner. Only material is confessional statement of co-accused. Petitioner is in custody since 12.09.2017.
Considering the aforesaid facts especially the fact that there is no substantial material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Motihari Town Police Station Case No.573 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
