The petitioner seeks bail in a case registered for the offences punishable under Sections 8/20/22 of the N.D.P.S. Act and under Section 30(a) of the Excise Act.

Learned counsel for the petitioner submits that in view of the liberty granted to the petitioner by order dated 11.01.2023 in Criminal Miscellaneous No. 1886 of 2023, the present bail application has been filed.

It is next submitted that by order dated 11.01.2023 in Criminal Miscellaneous No. 1886 of 2023, the petitioner was given liberty to renew his prayer after framing of charge. The learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.17124 of 2023(2) dt.12-04-2023 2/2 charges against the petitioner was framed on 17.02.2023 (Annexure-3).

Since, the charges against the petitioner stands framed, as such the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kathaiya P.S. Case No. 33 of 2021.

One of the bailors shall be the father of the petitioner namely Sri Ram Pravesh Kumar @ Ram Pravesh Rai. Further, in the event, if the learned Trial Court comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner, then the learned Trial Court shall forthwith cancel his bail bonds after recording reasons and take all coercive steps to ensure that petitioner is behind bars. Accordingly, the present regular bail application stands allowed.
