ANJANA MISHRA ORAL ORDER 22-08-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Jamui P.S. Case No.115 of 2016 for allegedly having committed the offence under Sections 467, 468, 471, 420 and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that though it is alleged in the F.I.R. that the petitioner had taken appointment on the basis of a fake certificate, even prior to the lodging of the present case, the petitioner had already resigned. It is further submitted that if so found, the petitioner undertakes to pay back to the State whatever remuneration he had received on the basis of such fake appointment as he was not aware that the

In view of the fact that the petitioner is no longer working and undertakes to deposit in the court below the amount which he had obtained by way of salary from the State, subject to the result of the present case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui, in connection with Jamui P.S. Case No.115 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. It is made clear that the amount to be deposited in the court below must be deposited within a period of three months, failing which it shall be open to the court below to cancel the bail bonds filed by the petitioner.
