JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-07-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 22.09.2017 in connection with Araria (Mahila) P.S. Case No. 51 of 2017 initially registered for the offences punishable under Sections 376, 313, 341, 323/34 of the Indian Penal Code and later on, Section 302 of the Indian Penal Code was also added.

The allegation against the petitioner is that he established physical relation with informant's daughter as a result whereof informant's daughter became pregnant and thereafter, petitioner and other accused got aborted her pregnancy but subsequently, the informant's daughter died.

Learned counsel appearing for the petitioner points

Patna High Court Cr.Misc. No.43271 of 2018 (2) dt.19-07-2018 2/2 out that in course of trial informant as well as her son have not supported the prosecution story, which is evident from perusal of Annexure-2 to the petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Araria in connection with Sessions Trial No. 78 of 2018 arising out of Araria (Mahila) P.S. Case No. 51 of 2017.
