Learned counsel for the petitioner submits that petitioner had applied for her appointment as Panchayat Teacher before the Mukhiya-cum-Chairman, Niyojan Samati, Narauli Panchayat, Bakhtiyarpur, Patna. She was waiting for counselling but till date no information of counselling has been given to the petitioner by the respondent no.7. 3.

He further submits that petitioner has got 63% marks

Patna High Court CWJC No.8263 of 2021 dt.01-08-2024 2/3 but she has not been called and the candidate having lesser marks has been appointed by the respondent no.7. 4.

He further submits that the petitioner moved before the Lokayukta, Bihar raising her grievances but the Lokayukta observed that petitioner has got remedy before the Appellate Authority and accordingly petitioner filed an appeal before the Niyojit Shikshak Appliya Pradhikar but ill date the same has not been disposed of.

Considering the facts, petitioner is directed to file an appeal before the District Appellate Authority within a period of two weeks along with a copy of this order and other documents in support of her claim and the District Appellate Authority is well advised to consider the case of the petitioner and dispose of the representation of the petitioner after affording an opportunity of personal hearing or through her counsel and pass a reasoned and speaking order in accordance with law within three months from the date of filing of such appeal by the petitioner.

With the aforesaid directions, this writ application stands disposed of.

The District Appellate Authority shall condone the delay in filing of the appeal in view of the fact that the present
