JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 467, 468, 470, 471, 406, 420, 34 of the Indian Penal Code.

It is alleged that the petitioner got Kisan Credit Card Loan from the State Bank of India on the basis of forged land possession certificate.

It is submitted that petitioner is not named in the F.I.R and during the course of investigation, it has came that at the relevant time petitioner was posted as revenue clerk. It is submitted that petitioner has not issued any forged rent receipt and LPC at the relevant date and time of occurrence. It is further submitted that there is 2 years dealy in lodging the F.I.R for which there is no reasonable explanation. Similarly situated co- accused person

Patna High Court CR. MISC. No.17229 of 2023(3) dt.03-07-2023 2/2 has already granted bail by this Court vide order dated 17.10.2017 in Cr. Misc. No. 48990 of 2017.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Begusarai in connection with Nimachandpura P.S. case no 04 of 2016, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
