The petitioner seeks bail in Special Case No. 125 of 2017 registered under Section 20 and 22 of the N.D.P.S. Act. 210 gm of ganja is said to have been recovered from the possession of the petitioner.
It is submitted by the learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. As a matter of fact, the said quantity of ganja was recovered from the packet wrapped in the cloth on the road as evident from the seizure list itself. The said quantity happens to be small quantity. The petitioner has no criminal antecedent. He has been languishing in custody since 23.08.2017.
