2. The petitioner, who had applied against the advertisement issued by the respondent/Commission for being considered for appointment on the post of Assistant Civil Engineer, is aggrieved by the fact that he has not been allowed to write the mains examination only on the ground of his being short of age by 21 days.

3. The main contention of the learned counsel for the petitioner is that in the event of his ineligibility of age, he ought not to have been permitted to write the preliminary examination in which he appeared and was declared

4. In any view of the matter, regard being had to the fact that the mains examination has already been held, this Court is loath in entertaining the present petition. The writ petition is dismissed accordingly.
