JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2017 Earlier, prayer of anticipatory bail of the petitioners was rejected vide order dated 08.04.2017 by this Court passed in Criminal Miscellaneous No. 12377 of 2017 with observation that the petitioners surrender before the court below and pray for regular bail and in any such application is filed, the court below after calling for the injury report and after verifying the nature of injuries, shall consider the application of petitioners and pass appropriate order, without being prejudiced by the order this Court.
Submission of the learned counsel for the petitioners is that the petitioners moved before the court below for grant of regular bail, which was rejected. Charge has been framed. They
Patna High Court Cr.Misc. No.52075 of 2017 (2) dt.15-11-2017 2/3 are in custody since 25.04.2017 and they are ready to abide any condition imposed upon them.
Heard learned APP also.
Having heard both sides and in view of facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of A.D.J. 9th Saran at Chapra in connection with Khaira P.S. Case No. 180 of 2016, subject to the conditions as follows:
(1) One of the bailors shall be a local person having sufficient immovable properties within the jurisdiction of the court concerned.
(2) The petitioner shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the
Patna High Court Cr.Misc. No.52075 of 2017 (2) dt.15-11-2017 3/3 prosecution will be free to move for cancellation of their bail bonds.
