Smt. Gulnar Begam ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 18-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Dehri (Indrapur) P.S.Case No. 213 of 2018 registered under Sections 376 and 511 of the Indian penal Code and 12 of the Protection of Children from Sexual Offences Act. Allegation in brief is that prosecutrix, a minor girl, was kidnapped in the night by four boys for committing rape and left her in the early morning.

Submission is that due to altercation with the family members of the prosecutrix, petitioner has been falsely implicated. Whereas it appears that girl is minor and apparently no dispute exists between both sides and marks of violence and injury also found on her person and the girl has supported the allegation in her statement recorded under Section 164 Cr.P.C. Having considered the nature of offence, the prayer of bail of the petitioner is presently rejected.
