JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending her arrest in a case instituted under Sections 387, 504 and 34 of the Indian Penal Code.

It is alleged by the informant that on 04.04.2013 to 07.04.2013 the informant has lodged FIR against the petitioner. It is mentioned that on mobile no.94314480400 of the informant a threatening was given from mobile no.840958228 that he is notorious person of Purnea and if the informant does not effect Nikah with his daughter then the consequence will be bad. The informant turned deaf-ear and switched off his mobile phone. Further on 07.04.2013 by same mobile number the informant was threatened on his other mobile that if the informant does not effect Nikah of his son then the informant has to pay rupees two lacs as Rangdari.

Patna High Court Cr.Misc. No.26316 of 2015 (4) dt.23-09-2015 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. Petitioner is a lady. It is further submitted that Annexure-3 to the supplementary affidavit a case which was instituted by the daughter of the petitioner against the informant and her son. In which under Section 164 Cr.P.C. statement was also recorded of the daughter of the petitioner which is Annexure-2 to the present application. In retaliation to the earlier case, the present case has been instituted with an intention to falsely implicate the petitioner and her family members.

It has been submitted on behalf of the State that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of her arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Khagaria in connection with Khagaria (Chitragupt Nagar) P.S.Case No.271 of 2013 (G.R.No.888 of 2013), subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
