In this case, the petitioners are seeking anticipatory bail in connection with Bathnaha P.S. Case No. 382 of 2017 (G.R. No.5364 of 2017), registered for the offence under Sections 147, 149, 188, 290, 285 and 353 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners were granted anticipatory bail by the Court below vide order dated 07.12.2018 in A.B.P. No.2109 of 2018, but on wrong impression of the period of surrender they failed to surrender himself before the Court below, whereafter they filed

Patna High Court CR. MISC. No.18341 of 2019(2) dt.27-03-2019 2/2 an application for extension of time, which has been rejected vide order dated 30.01.2019.

Looking to the entire facts and circumstances of the case, let the above-named petitioners, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Bathnaha P.S. Case no. 382 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
