JUSTICE SUDHIR SINGH ORAL ORDER 30-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 364, 366, 366A, 323/34 of the Indian Penal Code.

The allegation against the petitioner is that the petitioner eloped his own Sali. The informant's daughter is claimed to be minor.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the statement of victim girl has been recorded under Section 164 Cr.P.C. where she has admitted that she had gone to the house of the petitioner on her own will. The said statement of the victim is Annexure 3 to the supplementary affidavit.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Kishanganj in connection with Kochadhaman P.S.Case No. 242 of 2014 (G.R.No. 1903 of 2014), subject to the conditions as laid down u/s 438(2) Cr.P.C.
