The petitioner has prayed for the following reliefs: (i) for issuance of writ of appropriate nature, order or direction commanding respondents for re-determination of amount of compensation for the land acquired from the petitioner in Land Acquisition case no.22/12-13/16/1415 & Land Acquisition case

Patna High Court CWJC No.10271 of 2016(2) dt.30-04-2024 2/3 no.27/12-13/16/14-15 after assessing valuation of the land as per market value of the land or at the circle rate fixed by the state of Bihar on the date of acquisition. The petitioner had filed objection dated 11.7.15, 13.8.15, and others but neither his objections were referred before any authority for proper determination, nor his objections have not been considered in any way. The petitioner after receiving award amount under protest has also filed objection for reference, but no action is being taken on it;

(ii) for a direction to the respondents to properly assess price of land under acquisition, settle amount of compensation and pay difference of amount of the compensation of the land along with the interest before constructing building on the land.

3. A perusal of the petition would show that the land has been acquired and payment received by the petitioner. However, learned counsel for the petitioner submits that he may be given liberty to challenge the categorization of the land.

4. Granting such liberty, the writ petition stands disposed of.
