ANJANA MISHRA ORAL ORDER 19-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 30.05.2018 in connection with Manigachi P.S. Case No. 213 of 2017 registered for the offences punishable under Sections 363, 366A, 120(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the petitioner is named in the First Information Report yet the victim girl in her statement made under Section 164 Cr. P.C. has not named the present petitioner. It is further submitted that the victim girl has been found to be born on 02.10.2001 as per the certificate issued by the Bihar School Examination Board. Learned counsel for the petitioner next submits that she has taken the name of the two kidnappers as has been mentioned in paragraph No. 64 of the case diary and the petitioner's role has not been mentioned by the victim girl in her statement recorded under Section 164 Cr. P.C.

No.42606 of 2018 (2) dt.19-07-2018 2/2 Considering the aforementioned facts and circumstances and that the petitioner has got no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Darbhanga in connection with Manigachi P.S. Case No. 213 of 2017.
