The petitioner apprehends his arrest in connection with Sonepur P.S. Case No. 36 of 2015 registered under Sections 341, 323, 324, 325, 307, 379, 504 and 34 of the I.P.C. pending in the Court of A.C.J.M., Saran at Chapra.

The accusation is that co-accused Abhinash Kumar Singh gave sword blow causing injury on the head of the informant. Thereafter, this petitioner gave lathi blow in which his two teeth were uprooted.

Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case due to land dispute. It is also submitted that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the

Patna High Court Cr.Misc. No.17175 of 2015 (2) dt.03-06-2015 2/2 case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application stands rejected.

However, petitioner is directed to surrender before the Court below within a period of four weeks and pray for regular bail which shall be decided by the trial Court on merit without being prejudiced by this order.
