The State of Bihar .... .... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-06-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sirdala (Meskaur) P.S. Case No. 05 of 2015 registered under Sections 216(A) and 215 of the I.P.C. and Section 25(1-b)a/26/35 of the Arms Act.

The accusation is that the Police reached at the house of Sanjay Paswan and in connection to investigation of Ara Nawada P.S. Case No. 592 of 2014, Sanjay Paswan and this petitioner succeeded to flee away. Thereafter, on search of the house of Sanjay Paswan, one country made pistol loaded with magazine, one country made Katta, 10 cartridges of 12 bore, two empty cartridges of 3.15 bore and 3 live cartridges of 9 mm. were recovered.

No.17212 of 2015 (2) dt.03-06-2015 2/2 petitioner submits that petitioner is co-villager of the co-accused Sanjay Paswan and nothing has been recovered from the possession of this petitioner. It is further submitted that petitioner has falsely been implicated in this case by the Police, as earlier he has been made accused in Nawada (Aara) P.S. Case No. 592 of 2014 registered under Section 395 of the I.P.C. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M. Nawada in connection with Sirdula (Meskur) P.S. Case No. 05 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J.) Shail/- U T
