The petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 393/34 of the Indian Penal Code. Allegation is that the accused persons assaulted the informant and snatched his mobile phone and Rs.6500/-. It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.01.2020 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The name of the petitioner has transpired in this case on disclosure made by coaccused Vipul Kumar. There is no recovery of any incriminating article from the possession of the petitioner. He has not been put on T.I.P. Other co-accused has been granted bail vide Annexure

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 13th Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Chakia P.S. case No.179 of 2019.
