The petitioner has a grievance that ignoring his better claim, respondent No 7 has been granted licence to run a fair price shop under the Bihar Targeted Public Distribution System (for brevity, BTPDS) Control Order, 2016.

Learned counsel for the petitioner, after some

Patna High Court CWJC No.8245 of 2021(2) dt.04-02-2022 2/2 argument, submits that the petitioner may be given liberty to approach appropriate/statutory authority under the BTPDS Control Order to make out his claim that he had better merit than Respondent No 7, ignoring which Respondent No 7 has been selected.

Considering submissions advanced on behalf of the petitioner, this application is permitted to be withdrawn with the liberty, as sought and stands disposed of accordingly. If the petitioner approaches appropriate/statutory authority within four weeks from today, this Court expects that the concerned authority shall take appropriate decision as expeditiously as possible, preferably within three months from the date of receipt/production of a copy of this order.
