Heard learned counsels for the parties.

The petitioner is languishing in custody since 4.10.2018 in a case registered for the offences punishable under Sections 399,402 and 414 of the I.P.C. and Sections 25(1-B) a, 26 and 35 of the Arms Act.

The prosecution case as per the self-statement of SHO, Riga Police Station recorded on 4.10.2018 at 7.30 P.M., is to the effect that on the same day at 5.45 P.M., a secret information was received that some miscreants are preparing to commit dacoity, when raid was laid and from the possession of the petitioner one Hero Motorcycle was recovered, which is

It is submitted by learned counsel for the petitioner that the investigation has already been concluded. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. It is further submitted that there is no likelihood of the trial being concluded in near future. Learned APP submits that a stolen motorcycle was recovered from the petitioner.

Considering the fact that the investigation has already been concluded, statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Sitamarhi in connection with Riga P.S. Case No.292 of 2018.
