The petitioners seek bail in connection with Rajauli P.S. Case No. 166 of 2018 registered under Section 30(a) of the Excise Act, 2016.
65 liters of country made liquor is said to have been recovered from the motorcycle and petitioners sitting on the said motorcycle were apprehended.
It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from their conscious possession. They have no concern with the seized liquor. They have been falsely implicated in the case by the police merely on suspicion while they were passing through place of occurrence at the time of occurrence and real culprit
Patna High Court Cr.Misc. No.44076 of 2018(2) dt.20-07-2018 2/2 managed to escape dumping the aforesaid liquor there seeing the police party. The petitioners have no criminal antecedent. They have been languishing in custody since 29.05.2018. Considering the facts, aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Rajauli P.S. Case No. 166 of 2018 to the satisfaction of the Additional District & Sessions Judge II-cum-Special Judge, Nawadah. (Prakash Chandra Jaiswal, J) Shamshad/- U T
