1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Shahkund P.S. Case No. 126 / 2024 dated 13.07.2024 registered for the offence under Section 309(4) of the B.N.S. 2023.
3. As per the prosecution case while the informant was taking his D.J. instrument to Katahara in the night of 12.07.2024 suddenly on the way near a bridge situated between Mahto Asthan and Saraha at about 11:40 PM four unknown miscreants snatched D.J. instrument from the informant on the point of pistol and three-nut. It is further alleged that they assaulted him and his staff by tying their mouth with towel and all four miscreants ran away on motorcycle.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence in the manner alleged. He next submits that petitioner is not named in the
Patna High Court CR. MISC. No.18284 of 2025(3) dt.13-08-2025 2/2 F.I.R. The name of the petitioner has surfaced in this case during course of investigation in the confessional statement of the co-accused / Raj Kumar. He next submits that no incriminating article and / or looted property has been recovered from the conscious possession or from the house of the petitioner. He also submits that save and except confessional statement of the co-accused there is no material to connect the petitioner with the present case.

Regard being had to the submission made by the petitioner, taking into consideration the nature of allegation, the petitioner has criminal antecedent and the fact that petitioner's name has surfaced in the confessional statement of the co-accused / Raj Kumar which may be the basis of further investigation against the petitioner for which custodial interrogation may be necessary, accordingly, I am not inclined to grant anticipatory bail to the petitioner.
