JUSTICE ARUN KUMAR ORAL ORDER 12-12-2017 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Barhat P.S.Case No. 69 of 2017 registered under Sections 147, 148, 307, 323, 324, 325, 341 and 504 of the Indian penal Code.
Learned counsel for the petitioner submits that there is general and omnibus allegation against the petitioner regarding assault and the informant and petitioner are the agnates, however, specific allegation of assault is only against Mithlesh Pandey and Nawlesh Pandey and the petitioner is a student having no criminal antecedent, except one case lodged by the informant's side under Sections 323 and 342 of the Indian Penal Code in which the police submitted final form against him.
Having considered the aforesaid facts and circumstances,
Patna High Court Cr.Misc. No.57768 of 2017 (2) dt.12-12-2017 2/2 the petitioner, namely, Sanjeev Pandey is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Barhat P.S.Case No. 69 of 2017.
