Petitioner seeks bail in a case registered for the offences punishable under Sections 8/20(B)II/B of N.D.P.S. Act.

The allegation is of recovery of Ganja of 02 Kg and odd from possession of the petitioner. It appears that similarly situated some other co-accused have been granted bail by different Coordinate Benches of this Court considering the submission of non-compliance of the mandates under the N.D.P.S. Act in the matter of search and seizure.

Considering the fact aforesaid, let the petitioner, above named, be released on bail

Patna High Court Cr.Misc. No.41878 of 2018 (2) dt.19-07-2018 2/2 on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bairagniya Police Station Case No.01 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
