The petitioner apprehends his arrest in a case registered under Section 307 and other sections of the Indian Penal Code.

The informant, Ram Kishore Rai, alleged that all the accused persons came to his fields and Ram Pukar Rai Akhilesh Rai, Uday Rai and Gaurav Kumar inflicted dagger injury in his abdomen. Other accused persons are alleged to have assaulted Jagat Narain Rai and Shiv Chandra Rai with their weapons. Accused Uday Rai and Arun Rai are also alleged to have fired.

It appears that there is no specific allegation of assault against the petitioner. Similarly situated ten accused

Patna High Court Cr.Misc. No.34254 of 2014 (2) dt.12-02-2015 2/2 persons were enlarged on anticipatory bail by this Court vide order passed in Cr.Misc. No.50498 of 2013.

Considering the fact that there is no specific allegation of assault against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Sakra P.S. Case No.19 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
