The petitioner seeks bail in Trial No. 769/016, arising out of Shakurabad P.S. Case No. 111/2013, registered for the offence under Section 392 of the Indian Penal Code. Petitioner Somar Yadav and Birendra Yadav were apprehended while fleeing away after committing robbery in the shop of the informant. The prayer for bail of the petitioner was earlier twice rejected by this Court. On the last occasion, the prayer for bail of the petitioner was rejected vide order dated 30.09.2015 passed in Cr. Misc. No. 41562/2015 with the observation that if the trial is not concluded within six months, the petitioner may renew his prayer for bail. It appears that the petitioner is in jail since 29.05.2014. It is submitted that trial has not yet been concluded. The petitioner has already remained in jail

Patna High Court Cr.Misc. No.21648 of 2016 (2) dt.26-10-2016 2/2 for about two years and five months.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Amit Kumar Shukla, Judicial Magistrate 1st Class, Jehanabad in Trial No. 769/016 arising out of Shakurabad P.S.
