JUSTICE SATYAVRAT VERMA ORAL ORDER 15-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code read with Section 30(a) of the Bihar Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 18.11.2021, charge-sheet has been submitted in the case and has antecedent of five cases. Allegation is of recovery of 10 litres of liquor and 600 litres of raw material is alleged to have been destroyed on the spot.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name transpired in the confessional statement of co-accused Rajesh

Patna High Court CR. MISC. No.18275 of 2022(2) dt.15-04-2022 2/2 Manhi which has no evidentiary value. It is further submitted that because of his antecedents, the police got him implicated through Rajesh Manjhi.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case, he was not arrested from the spot and his name came in the confessional statement of co-accused, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bettiah Muffasil Manuapul P.S. Case No. 667 of 2021.
