The prayer for bail of the petitioner was earlier rejected vide detailed order dated 01.06.2021, passed in Cr. Misc. No.3696 of 2021.

By order dated 13.04.2022, report was called for from the court of learned Additional District and Sessions JudgeIIIrd, Araria regarding the stage of trial and the time likely to be taken in conclusion of the trial in connection with Kursakanta P.S. Case No.271 of 2019.

Perused the report at 'Flag-R'.

The I/C 3rd Additional District & Sessions Judge, Araria reported that charge in this case was framed on 24.02.2021. It is further reported that two PWs. have been

Patna High Court CR. MISC. No.17618 of 2022(3) dt.11-05-2022 2/2 examined. The case is at the stage of prosecution evidence and twelve charge sheet witnesses are yet to be examined. Taking into consideration the fact that there is direct allegation against the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected.

However, the learned trial court is directed to conclude the trial within a period of nine months from the date of receipt/production of a copy of this order. If the trial is not concluded within a period of nine months, the petitioner may renew his prayer for bail. The Superintendent of Police, Araria is directed to ensure the production of witnesses in the trial on the date fixed. Both the parties are directed to co-operate in the trial.
