JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,307,504 and 447/34 of the Indian Penal Code.
It is specifically alleged against the petitioner that he assaulted with sword on the head of the informant causing cut injury.
It is submitted by the learned counsel for the petitioner that the sharp cutting injury measuring 1⁄4" x 1/6" in size has been found to be simple in nature. There is no accusation of repeating the blow and there is counter version of the occurrence. More over, Title Suit is pending between the parties from before. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Birpur at Supaul in connection with Birpur P.S. Case No. 50 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
