The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30 (a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. It is a case of recovery of illicit liquor from the house of this petitioner.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner has clean antecedent. Learned APP appearing for the State opposed the anticipatory bail.
After considering the aforesaid facts and circumstances of the case as well as the fact that seized liquor
Patna High Court CR. MISC. No.17746 of 2022(2) dt.12-08-2022 2/2 was recovered from the house of this petitioner, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is rejected.
However, the petitioner is directed to surrender and seek regular bail which would be disposed of on its own merit without being prejudiced by this order.
