The petitioner seeks regular bail in connection with Excise Case No. 1446 of 2017 arising out of Mohania P.S. Case No. 474 of 2017 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding recovery of 3.7 litres of illicit liquor during the course of checking of the vehicle. The learned counsel for the petitioner submits that the recovery is from the co-accused person and not from the petitioner. It is further submitted that the petitioner is accused in one other case of same and similar nature in which he is on bail wherein the allegation was regarding the petitioner having been
Patna High Court Cr.Misc. No.58889 of 2017 (2) dt.22-12-2017 2/2 found in a drunken state and the petitioner is languishing in custody since 30.10.2017.
Considering the nature of accusation and the period of custody already undergone, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge cum A.D.J., 4th, Kaimur at Bhabua in connection with Excise Case No. 1446 of 2017 arising out of Mohania P.S.
