The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
The prosecution case as per F.I.R is that the informant and his brother-in-law were robbed by three unknown motorcycle borne criminals at gunpoint. It is further alleged that they also assaulted both of them and snatched the motorcycle, mobile and cash from the informant and his brother-in-law.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.17759 of 2022(4) dt.13-12-2022 2/3 petitioner that petitioner is innocent and he has falsely been implicated in this case. The F.I.R is against unknown. The petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. The name of the petitioner sprang up on the confessional statement of one apprehended accused. The confession before the police does not have any evidentiary value. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 12th, Muzaffarpur in connection with Sakra P.S.
