The petitioners, five in number, apprehend their arrest in a case registered under Section 384 and other sections of the Indian Penal Code.

Sanoj Yadav, the informant, made allegations against the petitioners that they, at the point of pistol, demanded money from him.

Learned counsel for the petitioners submits that the police, after investigation, submitted final form finding the allegations against the petitioners false but, thereafter, on the order of the Superintendent of Police, a petition under Section 173(8) of the Code of Criminal Procedure was filed for reopening the

Patna High Court Cr.Misc. No.34187 of 2014 (2) dt.10-02-2015 2/2 investigation and the learned Chief Judicial Magistrate ordered for investigation. Thereafter, on the prayer of the investigating officer, non-bailable warrant of arrest was issued.

Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Shashi Bhushan Kumar, Judicial Magistrate 1st Class, Bhagalpur in Lodipur P.S. Case No. 84/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
