JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 At the outset, it is submitted that petitioner no. 3 has already been arrested, hence, this application has become infructuous so far as it relates to petitioner no. 3. Heard learned counsels for the petitioners and the State. The petitioner nos. 1,2 and 4 are apprehending arrest in a case registered for the offences punishable under Sections 341,323,307,379 and 504/34 of the Indian Penal Code. The prosecution case is that in the background of dispute with regard to drainage the accused persons including the petitioners assaulted the informant, informant's nephew, wife and pregnant daughter.

No.28402 of 2015 (2) dt.24-07-2015 2/2 It is submitted by the learned counsel for the petitioners that in the background of a dispute with regard to drainage the occurrence took place and injury has been found to be simple when there is counter version of the occurrence also. Statement has been made in paragraph 3 of the petition that the petitioners has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner nos. 1, 2 and 4 be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Arwal in connection with Mehandiya P.S. Case No.44 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
