In this case, the petitioner is seeking regular bail in connection with Sessions Trial No.61 of 2017, arising out of Lakhisarai P.S. Case No.235 of 2016, registered for the offence punishable under Sections 302/201/120(B) of the Indian Penal Code.
Earlier the petitioner has moved before this Court for bail in Criminal Miscellaneous No.43349 of 2016 and this Court vide order dated 14.12.2016 rejected the bail application of the petitioner.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.56900 of 2017 (4) dt.28-02-2018 petitioner has remained sufficiently in the jail custody as he is in jail since 17.05.2016 and undertakes that the petitioner will remain present on each and every date of the trial and he will also co-operate with the early disposal of the trial, at the same time he also undertakes that the petitioner will not try to tamper with the evidence of the prosecution witnesses and if he tries to tampering with the witnesses in any manner, the court below will be at liberty to cancel the bail bonds of the petitioner. In view of the above statement made by the learned counsel for the petitioner, let the petitioner, namely, Shankar Singh, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, Lakhisarai, subject to the condition that one of the bails shall a close relative of the petitioner i.e. mother/father/sister and wife.
