Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Kasba P.S. Case No. 87 of 2022 dated 27.03.2022 registered for the offences punishable under Sections 272, 273 read with 34 of IPC and Section 30(a) of Bihar Prohibition and Excise Act. 3.
The main submissions advanced by learned counsel for petitioner are that the instant matter relates to the recovery of 490.875 litres of foreign liquor and the same is stated to have been recovered from the house of this petitioner but as per seizure memo the alleged liquor was recovered behind the petitioner's house from a hut which is made of tati-tin and the petitioner has fair and clean antecedent and one co-accused namely, Md. Naushad has been granted bail by a co-ordinate
Patna High Court CR. MISC. No.23502 of 2023(2) dt.12-05-2023 2/2 bench of this Court vide order passed in Cr. Misc. No. 37536 of 2022 and the petitioner has been languishing in jail since 03.08.2022 and the alleged liquor has not been recovered from his conscious possession and against him the investigation has been completed.

Learned APP for the State opposes the bail prayer of the petitioner.

Considering the above submissions and mainly the petitioner's fair and clean antecedent and the completion of investigation against him, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in connection with Kasba P.S. Case No. 87 of 2022.
